NOTICE OF ACTIONS TAKEN BY THE LAND USE BOARD 
BOROUGH OF WOODBINE

TAKE NOTICE that, on the 13th day of May 2026, the Land Use Board of the Borough of Woodbine in the County of Cape May took the following actions:
The Board granted a “by right” minor three (3) lot subdivision of Block 65 Lot(s) 1, 2, & 3, also known as 413 Adams Avenue with no variances required. This relief is conditioned upon approval of the Board Engineer and the Board Solicitor based on the following:
The minor subdivision shall adhere to the plan of Subdivision prepared by Van Note-Harvey (a division of Pennoni), under the seal of Lewis H. Conley Jr., New Jersey Professional Land Surveyor, dated May 6, 2025. The Applicant shall comply with all conditions of the NJ Pinelands Commission Resolution No. PC4-25-24, adopted August 8, 2025, which conditions are incorporated in the resolution by reference, including the recording of a deed restriction for 0.512 acres of the proposed 1.18 acre vacant lot, and the removal of all commercial vehicles from the parcel. The subdivision shall not be recorded with the Cape May County Clerk’s Office until a written response is provided from NJDEP, through the Licenses Site Remediation Professional advising that the proposed three (3) lot subdivision is consistent with all applicable NJDEP site remediation regulations, as requested by the Pinelands Commission.
Furthermore, no subsequent additions, alterations or changes can be made without further review by the Board, and any other proposed development of the parcel shall require completion of an application with the Pinelands Commission and shall be governed by the Borough of Woodbine’s certified land use ordinance and the Pinelands Comprehensive Management Plan. The Applicant shall comply with all provisions of the Borough of Woodbine Zoning and Land Development Ordinance and any and all municipal, County, State, and/or Federal Laws or regulations relating or applicable to the proposed project. The Applicant shall comply with the recommendations and comments of the Board Professional, Lewis H. Conley Jr., P.L.S., P.P., which are incorporated in the resolution, and the agreements made at the hearing shall be followed by the Applicant. The Applicant agrees to comply with specific items not contained within this Decision and Resolution, but which were otherwise set forth in the record of the hearing, which are incorporated in the resolution though not set forth at length herein.
Resolution No. 3-6-2026 memorializing decisions of the Woodbine Land Use Board with respect to the above matter was adopted at the last regular meeting of said Board on June 10, 2026. This Resolution is filed in the office of the Municipal Clerk and is available for public inspection.

The Planning/Zoning Board of the Borough of Woodbine has reviewed the upcoming amendments to the Open Public Meetings Act, N.J.S.A. 10:4-1 to -21, as passed pursuant to P.L.2025,c. 72, and finds that the online news publications of Cape May County Herald have online sections to publish legal notices that satisfy the new notice format requirements effective Mach 1, 2026. Applicants are free to use any other online news publication they deem satisfies the legal notice requirements. Applicants that publish a legal notice using an online news publication other than Cape May County Herald will be required to prove the online news publication outlet used satisfies the requirements effective March 1, 2026. Failure to prove the online news publication used satisfies the requisite requirements will result in the legal notice being invalid. 

TAKE NOTICE that on the 11th day of March 2026 the Land Use Board of the Borough of Woodbine in the County of Cape May took the following actions:

 

The Woodbine Land Use Board approved and adopted the Plan entitled “Borough of Woodbine, Cape May County, 2026 Amended Housing Element of the Master Plan Fair Share Plan,” prepared by Tiffany A. Morrissey, AICP, PP #5533.  The Board found that the Plan provided a realistic opportunity for the development of the Borough’s fair share of affordable housing and deemed it consistent with the requirements of the Fair Housing Act and the Municipal Land Use Law.  The Board also recommended that the Borough Council adopt any implementing ordinances and take such other actions as may be necessary to effectuate the Plan.  The Plan will be forwarded to the Borough Council and other appropriate parties. 

 

Resolution No. 2-3-26 memorializing decisions of the Woodbine Land Use Board with respect to the above matter was adopted at the same last regular meeting of said Board on March 11, 2026.  This Resolution is filed in the office of the Municipal Clerk and is available for public inspection.

Notice of Contract Award 2026

The Woodbine Land Use Board has awarded a contract without competitive bidding as a professional service contract pursuant to N.J.S.A. 40A:11-5(1) (a) to JON D. BATASTINI, ESQUIRE of the Law Office of Garrett & Batastini P.A. of Ocean City, New Jersey to act as Solicitor for the Board for 2026 and to VAN NOTE-HARVEY ASSOCIATES, Engineers/Planners of Cape May Court House, New Jersey, to act as Engineers/Planners for the Board for 2026 at its meeting held on January 14, 2026.  These contracts and the minutes of the Land Use Board meeting approving the appointments are available for public inspection at the office of the Borough Clerk, Woodbine Municipal Services Building, Woodbine, New Jersey during regular business hours.
